No New Charges Filed Yet On Baumgartner
As of Tuesday afternoon, no new charges have been filed against government critic Dr. Elsebeth Baumgartner in either Sandusky Municipal Court or Erie County Common Pleas Court.
Ottawa County officials allege that Baumgartner illegally eluded police during an attempted arrest at Terry’s Tavern in Bay View. Baumgartner alleges that the bench warrant used to arrest her was no good because it did not include a sworn charge as required by Ohio law. During a November 2004 EV investigation into the bench warrant Ottawa County Sheriff Bob Bratton claimed “there were always questions floating around about that warrant.” Bratton asked Ottawa County Probation Officer Jody Royster if he could "pull" the warrant until the legalities surrounding the issue could be clarified.
The Port Clinton News Herald reported that when Bratton was asked about the legitimacy of the warrant, he stated that it didn’t matter if the warrant was good or bad because Baumgartner had created new charges when “fleeing.”
Baumgartner’s hearing on “alleged probation violations” is tomorrow at 1:00 pm at the Ottawa Municipal building.
